Trademarks: Art. 13 TA provides that trademark owners have the exclusive right to affix the mark to goods or their packaging; it is infringing irrespective of whether or not such goods are thereafter placed on the market. By granting trademark owners the exclusive right to use a mark on business papers, in advertising or otherwise in the course of trade, the law encompasses the product-related use of a mark, e.g. as a domain name, trading name or a company name.
